Definitions

"Service" means the ApplyForMe platform and related features, including job search, intelligent matching, resume storage and adaptation, and optional automated application submission. "User," "you," and "your" mean the natural or legal person using the Service. "Content" means data, text, resumes, or other materials you upload or submit. "We," "us," and "our" mean the operator of ApplyForMe (full statutory name and postal address for Germany will appear in our Impressum before we broadly offer paid services to consumers in the EU; contact until then: [email protected]). If you are a "consumer" within the meaning of European or German law, mandatory statutory protections for consumers apply in addition to these Terms.

Legal notice (Impressum)

Under German law, we publish statutory provider information (Impressum) at /impressum on this website, including contact details and other legally required information. If anything in these Terms conflicts with the Impressum where the Impressum is more specific about our identity, the Impressum prevails as to those identification details.

Eligibility and account

You must be at least 18 years old and have capacity to enter into a binding contract. You must provide accurate registration information and keep it up to date. You are responsible for all activity on your account and must safeguard your credentials. Notify us promptly at [email protected] of any unauthorised use.

Description of the Service

ApplyForMe helps you discover job listings, match them to your profile using a smart system that scores relevance, store and adapt your resume, and—if you choose—submit applications on your behalf. Listings and employer information come from third parties and may be incomplete, outdated, or inaccurate. We do not guarantee that any listing is still available, lawful, or suitable for you. The Service does not provide legal, tax, employment, or immigration advice; matching scores are indicative only.

Your content and licence to us

You retain ownership of your Content. You grant us a non-exclusive, worldwide licence to host, process, transmit, display, and adapt your Content as needed to provide and improve the Service (including matching, ranking, resume adaptation, automated submissions, and support). You confirm you have the rights to grant this licence and that your Content does not infringe third-party rights or applicable law. You are solely responsible for the accuracy and legality of what you submit.

Our intellectual property

The Service, including its software, design, branding, and documentation, is owned by us or our licensors. Except for the limited rights to use the Service under these Terms, you receive no licence to our intellectual property. You may not copy, reverse engineer, circumvent technical limits, scrape, or resell access to the Service except where mandatory law allows.

Automated applications

If you use automation, you instruct us to act on your behalf at your own risk. Automation may fail, delay, or conflict with employer or third-party rules and could affect your accounts on external sites. You remain solely responsible for every application sent and for complying with third-party terms and applicable law. We do not guarantee successful delivery or any outcome.

Acceptable use

You must not misuse the Service: no illegal, fraudulent, or harmful activity; no attempt to probe or break our systems; no harvesting of job data to compete with us or resell bulk listings outside your personal job search; no impersonation. We may suspend or terminate access if we reasonably believe you violated these Terms, the law, or third-party rights.

Third parties

Employers, boards, and other third parties are independent of us. We are not responsible for their sites, policies, or conduct. Your use of external services may be governed by their terms.

Privacy

Our Privacy Policy describes how we process personal data. It is part of these Terms by reference. You acknowledge that you have read or had the opportunity to read the Privacy Policy. Processing is carried out as described there and as required by applicable law (including the GDPR where it applies).

Fees, plans, and changes

Some features may require payment. Prices, billing cycles, taxes, and scope of plans are shown at purchase. We may change fees or plan features for the future with reasonable notice; where you have an ongoing subscription and a change is detrimental, your statutory rights (including under German law if you are a consumer) remain unaffected. Refund or cooling-off rules depend on whether you are a consumer, what you purchased, and applicable law; our marketing statements about guarantees are additional to your statutory rights only where expressly stated and permitted.

Termination

You may stop using the Service and, where the product allows, delete your account. We may suspend or terminate access for breach, risk, legal duty, or operational reasons. Provisions that by nature should survive (e.g. liability limits where permitted, intellectual property, governing law) survive termination. Data handling after closure follows the Privacy Policy.

Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE EXTENT PERMITTED BY LAW—IN PARTICULAR, WITHOUT LIMITING RIGHTS THAT CANNOT BE WAIVED OR RESTRICTED FOR CONSUMERS UNDER GERMAN OR EU LAW—WE DISCLAIM WARRANTIES NOT EXPRESSLY STATED HERE. WE DO NOT GUARANTEE JOB OFFERS, INTERVIEWS, OR ANY PARTICULAR OUTCOME.

Limitation of liability

NOTHING IN THESE TERMS EXCLUDES OR LIMITS OUR LIABILITY WHERE SUCH EXCLUSION IS UNLAWFUL — INCLUDING FOR INTENT (VORSATZ), GROSS NEGLIGENCE (GROSSE FAHRLÄSSIGKEIT), INJURY TO LIFE, BODY, OR HEALTH, OR UNDER THE GERMAN PRODUKTHAFTUNGSGESETZ OR OTHER MANDATORY RULES. SUBJECT TO THE FOREGOING, OUR TOTAL LIABILITY FOR DAMAGES ARISING FROM OR IN CONNECTION WITH THE SERVICE (EXCEPT FOR BREACHES OF MATERIAL CONTRACTUAL OBLIGATIONS IN A WAY THAT ENDANGERS THE PURPOSE OF THE CONTRACT — "KARDINALPFLICHTEN") SHALL BE LIMITED TO THE GREATER OF (A) THE FEES YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, AND (B) ONE HUNDRED EUROS (€100), FOR ANY OTHER LOSS WHERE WE OR OUR LEGAL REPRESENTATIVES OR VICARIOUS AGENTS HAVE ACTED WITH ORDINARY NEGLIGENCE. THE ABOVE LIMITATIONS DO NOT APPLY TO LIABILITY FOR BREACH OF SUCH KARDINALPFLICHTEN ARISING FROM ORDINARY NEGLIGENCE, IN WHICH CASE LIABILITY IS LIMITED TO TYPICAL, FORESEEABLE LOSS. WE ARE NOT LIABLE FOR INDIRECT OR CONSEQUENTIAL DAMAGES WHERE SUCH EXCLUSION IS PERMITTED BY LAW.

Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless the operator of ApplyForMe (full statutory name and postal address for Germany will appear in our Impressum before we broadly offer paid services to consumers in the EU; contact until then: [email protected]) against third-party claims, losses, or costs (including reasonable legal fees) arising from your Content, your misuse of the Service, or your violation of these Terms or applicable law. This does not apply where mandatory consumer law prohibits such clauses.

EU dispute resolution and consumers

The European Commission provides a platform for online dispute resolution for consumers: https://ec.europa.eu/consumers/odr/. We are not obliged and may not be willing to participate in consumer arbitration proceedings before a dispute resolution body. If you are a consumer resident in the European Union, mandatory consumer protection rules of your country of residence apply where they provide stronger protection than German law alone.

Changes to these Terms

We may update these Terms. We will post the new version and change the "Last updated" date. For material changes, we will notify you where required by law (e.g. by email or clear in-product notice). Continued use after the effective date may constitute acceptance where permitted; where your consent is required, we will obtain it.

Governing law and jurisdiction

These Terms are governed by the laws of Germany, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG), subject to mandatory EU or national consumer protections where you are a consumer. If you are a merchant (Kaufmann) within the meaning of the German Commercial Code, or a legal entity under public law, the exclusive place of jurisdiction for disputes arising from these Terms is our registered seat in Germany (once published in the Impressum). If you are a consumer, you may bring proceedings in the courts of your place of residence or in Germany where the law allows; we may also sue a consumer at the consumer’s residence where permitted.
